What are the Penalties for a 2nd Offense DUI in NJ

A second offense DUI conviction in New Jersey will bring upon drastically worse penalties when compared to a first offense DWI. Unlike a first offense DWI conviction where the legislatures have allowed for two different ranges of potential license suspensions depending on the Defendant’s BAC, second offenses have only one potential outcome. Basically, if convicted of a second offense DWI conviction, a Defendant will be facing a mandatory two (2) year loss of driving privileges. In addition, the Defendant will also be facing up to ninety (90) days in the Monmouth County Jail, fines / assessments totaling approximately $1,000, forty-eight (48) hours in the intoxicated drivers resource center, thirty (30) days of community service and the installation of the ignition interlock device. Unlike criminal offenses, DWI convictions never “go away”; they are non-expunge-able and to make matters worse, they are enhanceable. With that being said, the legislatures have allowed for what is known as a “step-down”. If ten (10) years has elapsed since your first DUI conviction and your second DUI arrest the current charge may be stepped down and treated as a first offense. For more information on a “step-down” please contact our office at (732)858-6959.
