The Township of Wall Makes Selling Marijuana Illegal within Town Limits

Wall Township, one of the largest municipalities in Monmouth County, New Jersey, has formally invoked an ordinance that not only prohibits the sale of marijuana, but also prohibits the cultivation of weed within its borders.  Prior to voting, the committee listened to advocates for nearly an hour as they tried to persuade them to wait until all the facts were out before they passed the ban. However, the Wall Township Committee was unpersuaded and unanimously voted in favor of the ban. This was done based on the uncertainty that seems to linger when it comes to the legalization of marijuana in New Jersey.

The thirty-two square mile township of Wall, located in the southern region of Monmouth County, has joined the long growing list of municipalities that are proactively trying to prevent the sale of marijuana from occurring within the township, if and when marijuana is formally legalized in New Jersey. Point Pleasant has formally invoked an ordinance that prohibits the sale of marijuana, while other towns like  Toms River and Middletown have introduced proposed ordinances but have held off on formally invoking it until it is, in fact, legalized. Legislative experts believe that by legalizing marijuana, the potential tax revenue that would be created could reach $300 million. However, one of the major issues for most people is how much of that revenue will each town actually receive.

Until formal legislation is passed, marijuana is still illegal in New Jersey and law enforcement throughout the State is still proactively arresting and prosecuting those accused of possessing it. In fact, the possession of marijuana under 50 grams is still one of the most common criminal offenses litigated in the Wall Township Municipal Court. New Jersey as a whole takes marijuana offenses very seriously. Anyone charged will possession of marijuana under 50 grams will be facing a disorderly persons offense, which is New Jersey’s version of a misdemeanor. Which means, if convicted, an individual will not only be saddled with a criminal record but will also be facing up to six months in jail, a $1,000 fine, about $800 in fees and assessments and a six month loss of license.
