Facing a Car Burglary Charge in Freehold?

In New Jersey the courts treat car burglaries the same as they do a home invasion. Under the letter of the law, they are one and the same, even if people were home during the home invasion. So, what at first glance might seem minor on its face in reality is a rather serious offense. Burglary, which is governed by NJSA 2C:18-2, is typically considered a third degree indictable offense. However, if the individual is armed with a deadly weapon or someone suffers bodily injury then it will be a second degree felony. Regardless of the degree, both offenses could end with the individual being sentenced to a lengthy state prison sentence. Contrary to what most people think, the crime of burglary does have to include a theft. An individual will be charged with burglary in New Jersey if they enter a structure with the intent to commit an offense therein. So for example, if someone unlawfully enters a home with the intent to beat someone up inside, they will be charged with burglary. Need Lawyer for Car Burglary Charge in Hazlet

Through the Asbury Park Press as well as their Facebook Page, the Hazlet Police Department has announced that they have been dealing with a rash of car burglaries throughout the last week or so. Most of the car burglaries occurred near Beers Street and the Raritan Valley section of town. Although the majority of the car burglaries seem to involve the taking of personal items that were located inside the vehicles, at least of the vehicle’s was actually stolen. In that case, it is believed that the victim had left the key fob inside the vehicle. Most, if not all of the burglaries occurred during the early morning hours between 2 am and 5 am.

The Hazlet Police Department is not certain but it believes that the burglaries may have been committed by a group of individuals as opposed to a single individual. They are warning those throughout the area to be very cautious of what they leave inside the vehicle as well making sure the vehicles are locked.

If the individual(s) are apprehended they will be charged with burglary and various theft offenses and more likely than not be taken to the Monmouth County Jail pending their Central Judicial Processing Hearing (CJP). During their CJP hearing they will be informed of whether or not the State will be filing for detention. If they are filling for detention a detention hearing will be set.  If not, they will be released on bail pending their Pre-Indictment Conference.
