Facing Resisting Arrest Charges in Middletown New Jersey?

A verbal altercation between two contractor workers at Middletown High School North ends with one being arrested and charged with several indictable offenses. According to the reports, Middletown High School North security officers attempted to intervene and defuse the verbal altercation between the two independent contractors. Once that did not work, the security officers then attempted to have the main aggressor leave but he refused. To make matters worse, he then allegedly told the security guards that he would shoot them. Based on the escalating nature of the situation, the Middletown Police Department was notified but by the time they reported to the scene the individual had already left. However the officers were quickly able to locate the individual but when they did, things again escalated. This time they allege that he was being uncooperative and refusing to comply when they attempted to place him under arrest. Following what the officers are calling a brief physical struggle, they took the individual into custody. 

The individual, a 35-year-old male for Middletown was taken to the police station and formally charged with one count of resisting arrest and three counts of terroristic threats. Since these offenses are classified as indictable offenses (felonies) the charges will be transferred from the Middletown Municipal Court to the Monmouth County Prosecutor Office for prosecution. According to the Asbury Park Press the Defendant was charged on a summons-complaint which allowed for him to be released upon his own recognizance instead of being taken to the Monmouth County Jail and possible face a Detention Hearing.  Based on the way the charges were filed, the defendant will next have to appear in the Monmouth County Superior Court for his Central Judicial Processing Date. Terrorist threat charges are considered third degree indictable offenses in New Jersey. If convicted on the third degree terroristic threats charge alone the defendant could be facing anywhere from three to five years in a State Prison and a fine up to $15,000.
