New York Man Charged with Driving Under the Influence in Holmdel NJ
A Staten Island man was arrested and charged with driving under the influence following a motor vehicle accident that sent one to the hospital in Holmdel.
Based on the information that has been released at this point in time, the Defendant, a thirty-six year old male from New York was driving his Ford F-250 south on Middletown Road when he suddenly veered into the northbound lane. In doing so, the Defendant struck another vehicle that was heading north on Middletown Road, sending her car flipping down an embankment. The victim eventually rolled over and came to a stop at the bottom of a ditch. Once the Holmdel First Aid Squad arrived, the driver was taken to the Bayshore Community Hospital to be treated. Her injuries at this point in time are considered non-life-threatening.
The Defendant was placed under arrested and charged with among other things driving while intoxicated. Also, since an accident occurred and another individual suffered some form of an injury, the Defendant will most likely also be facing assault by auto charges as well. If the victim suffered what is known as “bodily injury” then the Defendant will be charged with assault by auto in the fourth degree. However, if the victim suffered what is known as “serious bodily injury”, then the Defendant will be facing a third degree felony charges. If the Defendant is in fact charged with assault by auto, all of the charges, including the DWI, would be transferred to the Monmouth County Superior Court, which is located in Freehold for disposition. If the Defendant is not charged with assault by auto, then the charges will be litigated in the Holmdel Municipal Court, which is located at 4 Crawfords Corner.

Although DWI offenses are technically considered “traffic offenses” the potential ramifications if convicted can be far worse then some disorderly persons offenses. They can include a lengthy license suspension, high fines, community service, court ordered rehabilitation, imposition of the ignition interlock device and even jail time. Since DWI offenses are considered traffic in nature, they will always be litigated in the local municipal court of the municipality where the incident happened. However, just like in the case above, if the Defendant is charged with an indictable (felony) level offense as well, like assault by auto, then the charges will be transferred to the Superior Court in the county where the incident occurred.
