DUI Checkpoint in Neptune Township

DWI / DUI Roadblock Scheduled in Neptune

The Monmouth County DWI Task Force is at it yet again this week. This time they are teaming up with the Neptune Township Police Department to set up a driving while intoxicated roadblock. The checkpoint is scheduled to take place Friday night on Route 33  from 11 p.m. to 3 a.m.. Any driver suspected of driving under the influence will be directed in the Jumping Brook Plaza parking lot to be further evaluated. More likely than not, once inside the lot, the suspect will be placed through several Standardized Field Sobriety Tests, including but not limited to the “Walk and Turn”, “One Legged Stand” and “Horizontal Gaze Nystagmus”. Anyone who fails these test will be taken to the Neptune Township Police Department, which is located at 25 Neptune Boulevard, to submit a breath sample to the Aloctest Machine. If it believed that the suspect is under the influence of a controlled dangerous substance (CDS), they will then be evaluated by what is known as a Drug Recognition Expert (DRE). A DRE will place the suspect through several test in order to try and determine whether or not the persons is under the influence and if so, what CDS. In addition to the DRE, a suspect may be asked to provide a urine or blood sample as well, which will be sent to a laboratory to be tested. These are just a few of the ways in which the police try and build their cases against any suspected drunk driver. If the Defendant refuses to submit a breath sample into the Alcotest Machine, they will be charged with refusing to submit a breath sample on top driving while intoxicated.

Anyone charged with driving while intoxicated, driving under the influence of drugs or refusal to submit a breath sample as a result of this DWI checkpoint will be forced to appear in the Neptune Township Municipal Court to answer for the charges. The Neptune Municipal Court is located right next to the police station at 25 Neptune Boulevard. Although DUI charges are considered traffic offenses, the potential ramifications are crippling. Even for a first time offender, the penalties could include a lengthy license suspension, high fines, imposition of the ignition interlock device, insurance surcharges and the intoxicated drivers resource center. Are DWI Checkpoints Legal in New Jersey?

Yes. The United States Supreme Court has ruled that DWI roadblocks/checkpoints are constitutional and do not violate the Fourth Amendment, the right to be free from unreasonable search and seizures. New Jersey requires that the public be put on notice that a roadblock is going to be conducted. This notice is usually done via a posting on the internet and in the local papers. In order for a DWI checkpoint to be considered valid in New Jersey, the police must follow strict procedures. They include but are not limited to the following, the stop must short in duration and be for the purpose of trying to determine if someone is operating under the influence.
