Burglary & Eluding Charges Issued in Monmouth County NJ

A wild chain of events ends in with a Little Egg Harbor resident being charged with among other things, a slew of burglary and receiving stolen property charges. According to nj.com, the Defendant, a twenty-seven year old male, is alleged to have burglarized a home in Hazlet around 3 am Sunday morning. While doing so, the Defendant made off with the victim’s vehicle and when the Hazlet Police Department attempted to pull him over around 5 am, he took them on a wild chase, that ended when he drove into an in-ground pool. But it did not end there, the Defendant was actually able to the flee the scene and make it back to the Shore Point Inn hotel, which is located on Route 35 in Hazlet. However, the police were quickly able to apprehend the Defendant at the hotel and take him into custody without anymore issues. In all, it took fifteen police officers from Hazlet and surrounding towns, including various K9 unites to finally locate the Defendant.

The Defendant was formally charged more than eight burglaries, eluding, theft of a motor vehicle, hindering apprehension, resisting arrest, unlawful possession of a weapon, possession of a weapon, aggravated assault on a police officer, receiving stolen property and a slew of motor vehicle offenses. He was most likely taken to the Monmouth County Jail, which is located in Freehold, where he is most likely pending a Detention Hearing. During that hearing, the Monmouth County prosecutor’s office will be seeking to convince the Judge that the Defendant must be detained in the Monmouth County Jail, without bail, pending trial.

When someone is alleged to have been involved in a series of burglaries and they are not caught in the act but they are caught with the merchandise, the prosecution may only have the ability to charge the individual with receiving stolen property.  Receiving stolen property seeks to punish anyone who is caught with the stolen property and not the actual act of taking the property. Conversely, burglary seeks to punish anyone who enters a structure with the intent to commit a crime therein. More often than not, the “crime therein” is a theft but with that being said, you can have a burglary charge without have an underlying theft offense.
